GRAN FONDO ARGENTINA – TERMS & CONDITIONS
1. Definition
The Gran Fondo Argentina is a cycling race where the riders are timed individually from the start to the finish. The event is organized in the Argentine Republic by Gran Fondo Asociacion Civil (hereinafter the “Organizer”).
The race will take place on Sunday, June 18th, 2023, at 6:30 AM with departure and arrival at the Hilton Hotel in Puerto Madero.
2. Inscription
Registrations will be considered final once paid; They are not refundable, transferable or deferrable. There is no possibility of refunding the registration in case the participant cannot participate in the race.
3. Personal identification
At the time of registering for the race and picking up their rider’s kit, participants must present a personal identification (Identity card, DNI, LE or Passport) valid on the date of the race and with a clear photograph.
4. Preparation and Medical Certificate
The “Organizer” recommends that all participants make effective preparation for the competition. It is a requirement, in order to participate in the race, that at the time of registration the riders present a certificate of physical fitness signed by a doctor with registration authorized by either the respective authorities of their country of residence or the Argentine Republic.
5. Inability to Participate
In the event that an entrant cannot participate in the race, they may request the “Organizer” to deliver the kit with the jersey and the commemorative gifts. If they cannot personally attend to get them, they must send an email to info@granfondoargentina.com authorizing another person to go to the registry office with their personal identification. For security reasons, the rider’s kit will not be dispatched by post or by any other form of delivery.
6. Personal and Non-Transferable Registration
Participants acknowledge that registration in the race is personal and non-transferable and accept that it is strictly prohibited to exchange, sell, or transfer their place in the race, or allow another person to use their number and/or timing chip and/or participate in their place. If it is determined that this infraction has been committed, the “Organizer” may exclude the registrant from participating in this race and in future Gran Fondo Argentina’s events.
7. Cancellation Due to Force Majeure
In the event of extraordinary weather conditions or causes of Force Majeure not attributable to the Organizer and that force the route to be modified, or make it impossible to carry out the race, the Organizer will not assume any responsibility and will not refund the registration fee. In this case, the race will not be suspended but the date of completion will be changed.
8. COVID-19
In the event that the race should be canceled by resolution of the enforcement authority of the Argentine Republic as a result of the COVID-19 pandemic, registrants may choose to: a) receive a credit, valid for two years, to run in the next edition of the Gran Fondo Argentina, or b) request the reimbursement of the amount paid according to the percentages detailed below:
- from the opening of the registration until April 18th, 2023: 50% refund.
- from April 19th to May 31st, 2023: 30% refund.
- from June 1st, 2023 to race day: no refund.
9. Liability and Insurance
Participants acknowledge that they must have sufficient insurance coverage for civil liability, personal accidents and/or personal items. They also agree that the “Organizer” will not be liable to them, or to third parties, for any direct or indirect damage arising from their participation in the race, or for any loss or damage to their personal equipment, or for any loss of business, income, or promises made on their behalf. The “Organizer” will not be responsible for the actions of the spectators or other third parties on the riders.
Participants accept that any mechanical support received on their bicycle from the “Organizer”, partners, riders or other third parties is at their sole discretion. Consequently, they accept to be exclusively responsible for a subsequent malfunction of the bicycle, or resulting injuries, refraining from holding the Organizer and/or a third party responsible. They also accept that in the event that their bicycle should be transported during the event in a vehicle, such as the Broom Vehicle, it will be transported at the risk of the participant, releasing the “Organizer” from all liability for damages that may be caused to it during transport.
10. Timing and Race Results
The “Organizer” will make every effort to provide the participants with their official times during the race, for which they will receive, at the time of registration, the identification number with an incorporated timing chip that must be attached and clearly visible at all times in the front of the bicycle handlebar. The “Organizer” is not responsible for any anomaly in the results of the computer or any technical malfunction.
11. Modification of the Start Date and Time
The “Organizer” reserves the right to modify the start date and/or time of the race. In the event of a change in date and/or time, riders will be notified of the new start time as far in advance as is reasonably possible. No total or partial refund will be made for any change in the race start day and/or time.
12. Modification of Distance or Circuit
The riders acknowledge that the “Organizer” may modify the format of the race such as reducing the distance, changing the route, or making any other modification of the circuit that it deems necessary. Participants also agree that the “Organizer” reserves the right to modify or cancel the event for any reason related to security. Any change in the event will be communicated as far in advance as possible.
13. Participant Removal
The “Organizer” reserves the right, at any time, to withdraw a participant from the competition or prevent a participant from riding in the competition if it considers that such action is necessary for security reasons, or for any other justified reason. No registration refund will be made if the participant acts negligently, maliciously, with intentional misconduct, or without due care and attention for the event, or other riders.
14. Allergies
It is important to note that some of the food products delivered during the race may contain or contains nut (or dried fruits) parts and nut oils, or may have been made together with other nut-containing products. The “Organizer” is not responsible for any problem derived from food allergies.
15. Protection of Personal data (LOPD)
Participants agree that, for the purposes of this event, their personal information (including medical information) may be collected for the purposes of health, safety, product delivery, and marketing related to the Gran Fondo Argentina (hereinafter “Personal Information”).
All the data provided by the participants will be incorporated into an electronic file owned by the “Organizer”, with the sole purpose of registering and controlling the participants’ access to the race. “Personal Information” will not be used for any other reason than that of this competition, nor will it be given to any person or organization that is not related to it.
The “Organizer” will use all necessary measures to ensure that the “Personal Information” in its possession, or that of its race partners, is not used or reproduced in whole or in part in any way except for the purposes described in these Terms and Conditions.
16. Image rights
Acceptance of this Terms and Conditions implies that the participants authorize the “Organizer” to use images of their person as long as it is related to the event.
With the registration, the participants admit and authorize the “Organizer” to use their image in any graphic or digital format and in all its forms (radio, press, video, photo, DVD, internet, posters, media, etc.) and assign all the rights related to its commercial and advertising exploitation that the “Organizer” deems appropriate to execute, without the right to receive any financial compensation.
17. Communication Via e-Mail
The “Organizer” will mainly use e-mail to communicate with the registrants. By participating in this race, riders agree to receive emails related to the event.
The “Organizer” is not responsible if the race information does not reach the intended recipient by e-mail. It is the responsibility of each participant to ensure that the spam filters on their electronic equipment allow them to receive emails from the “Organizer”, for example, by adding info@granfondoargentina.com to their address books.
18. Acceptance of the Terms and Conditions and the Rules
By registering and paying the registration ticket, the riders understand and accept these “Terms and Conditions” of participation of the Gran FondoGran Fondo Argentina and the “Race Rules”.
19. Final Decision
All resolutions and decisions of the “Organizer”, its employees, and agents are considered final and cannot be appealed. The participants agree to comply with all the rules of the race and the instructions given by the team of the event (directors, judges, commissioners, officers, etc.) and security personnel.
They also acknowledge that the “Organizer” will have exclusive authority and will be the final arbiter of all decisions related to the race, organization and safety of the race.
20. Disputes and Jurisdiction
All claims must be made in writing, in Spanish, mentioning the name, surname, and rider number. They must be sent to the Gran Fondo Argentina legal headquarters, located at Av. Las Heras 4081, 6 “A”, (CP 1425), CABA, Argentina, within 30 days following the announcement of the results of the race. Any claim that is made after that period will not be accepted.
These Terms and Conditions of participation are subject to the laws of the Autonomous City of Buenos Aires and the Argentine Republic.
21. Modification of the Terms and Conditions
The “Organizer” reserves the right to modify at its sole discretion these Terms and Conditions of participation, in whole or in part, as it deems necessary. Likewise, the right of admission is reserved.
